These Terms of Service (“Terms”) govern access to KoreanClothing.net and purchases made from Korean Clothing.

KoreanClothing.net is operated by Loother Holdings LLC, a Delaware limited liability company (“Korean Clothing,” “we,” “us,” or “our”).

By accessing the website, creating an account or placing an order, you agree to these Terms. If you do not agree to these Terms, you must not use the website or place an order.

Nothing in these Terms excludes, restricts or replaces consumer rights that cannot legally be waived or limited.

1. ELIGIBILITY AND LAWFUL USE

You must have the legal capacity to enter into a binding contract in your jurisdiction to place an order.

If you use the website or place an order on behalf of a company or other organization, you confirm that you have authority to act on its behalf.

You may not use the website:

  • For any unlawful, fraudulent or abusive purpose;

  • To infringe another person’s intellectual-property, privacy or other legal rights;

  • To introduce viruses, malicious code or harmful technology;

  • To interfere with the website’s operation, security or accessibility;

  • To gain unauthorized access to accounts, systems or information;

  • To make fraudulent purchases, chargebacks or payment claims;

  • To scrape, copy or access the website through automated means contrary to our instructions or applicable law; or

  • To impersonate another person or provide false information.

We may restrict or suspend access where reasonably necessary to protect the website, our customers, our business or another person’s rights.

2. PRODUCT INFORMATION

We make reasonable efforts to display product descriptions, photographs, colors, measurements, materials, sizing information, availability and care instructions accurately.

However, colors and appearance may vary because of screen settings, lighting, photography and normal manufacturing variations. Measurements are approximate unless expressly stated otherwise.

Customers should review the product description and available size information before ordering.

References to “Korean,” “Seoul” or similar terms generally describe a product’s style or aesthetic inspiration. These references do not, by themselves, state that the product was designed or manufactured in Korea.

Where country-of-origin information is displayed on a product, its packaging or the relevant product page, that information applies to the product.

If an item is materially different from its description, defective or otherwise non-conforming, the remedies provided by our Return & Refund Policy and applicable law will apply.

3. PRICES, TAXES AND PROMOTIONS

Prices are displayed in the currency selected or shown on the website or at checkout.

The final amount payable, including any taxes and shipping charges collected by us, will be displayed before the order is submitted.

International orders may be subject to duties, import taxes, brokerage fees or customs charges that are not collected by us. Additional information is provided in our Shipping & Delivery Policy.

We may change product prices prospectively at any time. A price change will not affect an order that we have already accepted unless the customer agrees or applicable law permits the change.

Discounts, crossed-out prices, promotional claims and comparison prices must be based on truthful information.

Where applicable law requires a price reduction to be based on a legally defined prior price, we will calculate and display the reduction using the required reference price.

Promotions may be subject to stated:

  • Start and end dates;

  • Product exclusions;

  • Geographic restrictions;

  • Minimum purchase amounts;

  • Maximum discounts;

  • Redemption limits; or

  • Other conditions.

Promotions cannot be combined unless expressly stated otherwise.

4. ORDERS AND CONTRACT FORMATION

Submitting an order constitutes an offer to purchase the products in the order.

An automated order acknowledgment confirms that we have received the order. It does not necessarily mean that the order has been accepted.

Unless applicable law provides otherwise, we accept an order when we send a shipping confirmation or otherwise expressly confirm that the order has been accepted.

We may refuse or cancel an order before acceptance for legitimate reasons, including:

  • Payment failure;

  • Suspected fraud or unauthorized payment activity;

  • Incorrect customer or delivery information;

  • Inventory or availability errors;

  • Obvious pricing or product-description errors;

  • Shipping or carrier limitations;

  • Product restrictions;

  • Sanctions or other legal restrictions; or

  • Suspected resale, misuse or excessive ordering.

If we cancel an order after payment has been collected, we will issue a prompt refund to the original payment method.

We may place reasonable limits on quantities purchased by the same person, household, delivery address, account or payment method.

Nothing in this section affects any rights a customer has under mandatory consumer law.

5. PAYMENT

Customers authorize us and our payment-service providers to charge the payment method selected at checkout for the total amount shown before the order is submitted.

Customers confirm that:

  • The payment and billing information provided is complete and accurate;

  • They are authorized to use the selected payment method; and

  • Sufficient funds or credit are available to complete the transaction.

Payments are processed through third-party payment-service providers. Payment processing may be subject to the provider’s separate terms, security procedures and privacy practices.

We may conduct payment, identity, address or fraud-prevention checks before processing or shipping an order.

An order may be delayed, refused or cancelled if payment cannot be authorized or verified.

6. SHIPPING AND DELIVERY

Our Shipping & Delivery Policy forms part of these Terms.

The Shipping & Delivery Policy explains:

  • Shipping destinations;

  • Processing times;

  • Estimated delivery times;

  • Shipping charges;

  • Free-shipping availability;

  • Tracking;

  • Delayed deliveries;

  • Incorrect addresses;

  • Lost or damaged parcels;

  • Customs charges; and

  • Delivery-related cancellation rights.

Processing and delivery times are estimates unless we expressly offer and confirm a guaranteed service.

Risk of loss or damage transfers according to applicable law. Where consumer law requires us to remain responsible until the customer or a person designated by the customer receives the goods, these Terms do not transfer that risk earlier.

7. CANCELLATIONS, RETURNS AND REFUNDS

Our Return & Refund Policy forms part of these Terms.

That policy explains:

  • Order-cancellation requests;

  • Voluntary returns;

  • Statutory withdrawal rights;

  • Faulty, damaged or incorrect items;

  • Non-returnable products;

  • Return procedures;

  • Return shipping costs;

  • Refund methods; and

  • Refund processing times.

Customers may request cancellation before shipment through our Contact page.

Cancellation is not confirmed until we expressly approve it. Fulfillment may begin quickly or automatically, so we cannot guarantee cancellation after an order has been submitted.

Nothing in these Terms or our Return & Refund Policy limits any mandatory right to cancel, reject goods, request repair or replacement, obtain a price reduction or receive a refund under applicable consumer law.

8. CUSTOMER ACCOUNTS

Where customer accounts are available, customers are responsible for maintaining the confidentiality of their login details and restricting unauthorized access to their accounts.

Customers must provide accurate and current account information.

Please notify us promptly through our Contact page if you believe that an account has been accessed or used without authorization.

We may suspend, restrict or close an account where reasonably necessary to:

  • Protect the customer or other users;

  • Prevent fraud or unlawful conduct;

  • Investigate suspicious activity;

  • Enforce these Terms; or

  • Comply with applicable law.

Closing an account does not automatically cancel an order that has already been accepted.

9. REVIEWS AND CUSTOMER CONTENT

Customers may be able to submit reviews, photographs, comments, questions or other content.

By submitting content, you confirm that:

  • It reflects your genuine experience or opinion;

  • It is truthful and not misleading;

  • You have the right to submit it;

  • It does not infringe another person’s rights;

  • It does not disclose another person’s private information without permission;

  • It is not defamatory, threatening, hateful, obscene or unlawful; and

  • It does not contain malicious code, spam or unauthorized advertising.

You retain ownership of your original content.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, translate, display and use the content for operating, improving and marketing Korean Clothing and its products.

This license is limited to uses consistent with applicable law and our Privacy Policy.

We may moderate, reject or remove content for reasons including:

  • Fraud or manipulation;

  • Irrelevance;

  • Abuse or harassment;

  • Privacy concerns;

  • Intellectual-property infringement;

  • Unlawful content;

  • Spam; or

  • Violation of these Terms.

We do not require a positive review as a condition of receiving an incentive. Where a review or endorsement is connected to a discount, free product, payment or another material relationship, that connection must be clearly disclosed.

We do not knowingly purchase, create or publish fake customer reviews.

10. INTELLECTUAL PROPERTY

Unless otherwise stated, the website’s original text, graphics, layout, branding, logos, photographs, videos and other content are owned by us or used with permission.

This content is protected by applicable copyright, trademark and other intellectual-property laws.

You may access and use the website for personal, non-commercial shopping purposes.

You may not, without prior written permission:

  • Reproduce or republish substantial website content;

  • Use our branding or logos;

  • Modify or create derivative versions of our content;

  • Sell, license or commercially exploit website content;

  • Remove copyright, trademark or ownership notices; or

  • Suggest an unauthorized association with or endorsement by Korean Clothing.

Third-party brand names, trademarks and other intellectual property belong to their respective owners.

A truthful reference to a third-party brand or product does not imply sponsorship, affiliation or endorsement.

We do not authorize the sale of counterfeit goods or the misleading use of another party’s intellectual property.

Suspected infringement may be reported through our Contact page. The report should include:

  • Identification of the copyrighted work, trademark or other right;

  • The relevant product or website URL;

  • The reporting party’s contact information;

  • An explanation of the alleged infringement; and

  • A statement that the report is made in good faith.

We may request additional information before acting on a report.

11. THIRD-PARTY SERVICES AND LINKS

The website may use, integrate with or link to independent third-party services, including:

  • Shipping carriers;

By using the website, you acknowledge that personal information will be handled as described in the applicable Privacy Policy and privacy notices.

13. WEBSITE AVAILABILITY AND DISCLAIMERS

We make reasonable efforts to keep the website available, accurate and secure.

However, the website may occasionally be unavailable because of maintenance, technical problems, security incidents, third-party service failures or circumstances outside our reasonable control.

To the fullest extent permitted by law, the website is provided on an “as available” basis. We do not guarantee that access will always be uninterrupted, secure or error-free.

This section applies to website access and does not exclude or reduce:

  • Product-conformity requirements;

14. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for:

  • Fraud or fraudulent misrepresentation;

  • Willful misconduct;

  • Death or personal injury caused by negligence;

  • Gross negligence where it cannot legally be limited;

  • Breach of mandatory consumer rights;

  • Product liability that cannot legally be excluded; or

  • Any other liability that applicable law does not permit us to exclude or limit.

To the fullest extent permitted by law, we are not liable for indirect or consequential losses arising from use of the website where those losses were not reasonably foreseeable when the relevant contract was formed.

We are not responsible for business losses suffered by a customer purchasing wholly or mainly for personal use.

For business users only, and to the fullest extent permitted by law, our aggregate liability arising from a particular order will not exceed the total amount paid for that order.

This business-user limitation does not apply to liability that cannot legally be excluded or limited.

Some jurisdictions do not permit particular disclaimers or limitations. Where that is the case, the relevant limitation applies only to the maximum extent permitted by law.

15. RESPONSIBILITY FOR UNLAWFUL MISUSE

Customers are responsible for losses directly caused by their fraudulent, unlawful or intentionally harmful use of the website.

Consumers are not required to indemnify us for:

  • Our own negligence or wrongdoing;

  • Losses not caused by the consumer;

  • Losses that were not reasonably foreseeable; or

  • Obligations that applicable consumer law does not allow us to transfer.

Where the website is used for business purposes, the business user agrees, to the extent permitted by law, to compensate us for reasonable losses resulting directly from:

  • Its unlawful misuse of the website;

  • Its infringement of another party’s rights; or

  • Its material breach of these Terms.

16. EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for a delay or failure caused by an event outside our reasonable control, including:

  • Natural disasters;

  • Severe weather;

  • War, terrorism or civil unrest;

  • Epidemics or public-health emergencies;

  • Government action;

  • Customs disruption;

  • Labor strikes;

  • Carrier interruption;

  • Internet or telecommunications failure;

  • Cyberattacks; or

  • Failure of an essential third-party service.

This section does not remove any statutory right to cancel an order, obtain a refund or receive another remedy where applicable law provides that right.

We will take reasonable steps to reduce the effect of such an event and communicate material delays where reasonably possible.

17. GOVERNING LAW AND DISPUTES

Subject to mandatory consumer protections, these Terms and any dispute arising from them are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

This choice of law does not deprive a consumer of mandatory protections available under the law of the country in which the consumer habitually resides where those protections apply.

Courts located in Delaware may have jurisdiction over disputes, but this is not intended to prevent a consumer from bringing a claim in another court where mandatory law permits or requires it.

Before beginning formal proceedings, customers are encouraged to contact us through our Contact page so that we can attempt to resolve the issue.

Informal contact is voluntary unless applicable law or a separately agreed dispute procedure provides otherwise. It does not extend a legal limitation period or prevent a customer from seeking urgent or legally protected relief.

18. CHANGES TO THESE TERMS

We may update these Terms prospectively to reflect changes to:

  • Our services or business practices;

  • Website functionality;

  • Payment or delivery arrangements;

  • Applicable law; or

  • Security and fraud-prevention requirements.

The revised Terms will be posted with an updated “Last updated” date.

We will provide additional notice where required by applicable law.

A change will not retroactively alter an order that has already been accepted unless:

  • The customer agrees;

  • The change benefits the customer; or

  • Applicable law requires the change.

19. SEVERABILITY AND WAIVER

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the minimum extent necessary.

The remaining provisions will continue to apply.

A delay or failure to enforce a right does not waive that right.

A waiver is effective only for the specific matter for which it was given.

20. TRANSFER OF RIGHTS

We may transfer our rights and obligations in connection with a merger, acquisition, corporate reorganization, financing or sale of all or part of our business, subject to applicable law.

A transfer will not reduce a consumer’s existing contractual or statutory rights.

Customers may not transfer their obligations under these Terms without our prior written consent, except where applicable law permits otherwise.

21. ENTIRE AGREEMENT

These Terms, together with the policies incorporated into them, form the agreement governing website use and purchases from Korean Clothing.

They include our:

  • Shipping & Delivery Policy;

  • Return & Refund Policy;

  • Privacy Policy; and

  • Any additional conditions clearly disclosed on a product page, promotion or at checkout.

Nothing in this section excludes a representation, warranty or right that applicable law does not allow us to exclude.
